Terms of Service

1. Acceptance of Terms

By downloading, installing, or using CardCue Pro ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

CardCue Pro is a personal gift card, loyalty card, and punch card tracking application. The App helps users track balances, receive location-based reminders, scan cards using AI, and organize their cards. CardCue Pro is a tracking tool, it does not store actual gift card monetary value, process payments, or guarantee card balances.

3. User Accounts

You may create an account using Apple Sign In or email. You are responsible for maintaining the security of your account credentials. You may use the App without an account with limited functionality (free tier).

4. Free and Pro Tiers

4.1 Auto-Renewing Subscriptions (App Store disclosure)

Subscriptions to the Pro tier are sold through Apple's App Store. By purchasing a subscription you authorize the following, as required by Apple and applicable consumer-protection law:

6. Gift Card Data Accuracy

CardCue Pro relies on user-entered data and AI scanning to track gift card balances. We do not guarantee the accuracy of scanned information. Users should verify balances directly with the card issuer. Cue is not responsible for discrepancies between tracked balances and actual card values.

7. Location Services

The App uses location services to provide nearby store alerts. Location accuracy depends on your device's GPS and network connectivity. We do not guarantee the accuracy of store location data or distance calculations. Location-based notifications are provided as a convenience and should not be relied upon as the sole means of tracking store locations.

8. AI Card Scanning

The AI scanning feature uses Anthropic's Claude API to extract text from gift card images. While we strive for accuracy, AI-powered scanning may occasionally produce incorrect results. Users should verify all scanned information before saving.

9. Intellectual Property

CardCue Pro, including its design, code, and content, is the intellectual property of Pika Product Lab LLC (doing business as CardCue Pro) and is protected by copyright and other intellectual property laws. Gift card brand names, logos, and trademarks referenced in the App belong to their respective owners.

10. Limitation of Liability

Cue is provided "as is" without warranties of any kind. To the maximum extent permitted by law, CardCue Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of gift card value, missed expiration dates, or inaccurate balance tracking. Nothing in this Section excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

10.1 Consumer-Law Carve-Outs (Mandatory National Protections)

Sections 6, 7, 8, 10, and 11 do not apply to the extent they would be unenforceable under consumer-protection law in your country of residence. In particular:

You agree to indemnify and hold harmless CardCue Pro and its developers from any third-party claims, damages, or expenses arising from (a) your use of the App in violation of these Terms, (b) content you add to the App, or (c) your violation of applicable law. This Section does not apply where indemnification by a consumer is restricted by mandatory law (e.g. consumers in Australia, Brazil, Japan, and other jurisdictions with equivalent protections, see Section 10.1).

12. Termination

We reserve the right to terminate or suspend your access to the App at any time for violation of these terms. You may stop using the App at any time by deleting it from your device.

13. Changes to Terms

We may update these terms from time to time. Continued use of the App after changes constitutes acceptance of the revised terms. We will notify users of significant changes through the App.

14. Governing Law

These terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Consumer protections in your country of residence continue to apply: if you are a consumer resident in a jurisdiction with mandatory consumer-protection law, nothing in these Terms deprives you of protections you cannot waive by contract (including, where applicable, the right to bring proceedings in the courts of your country of residence and to have disputes decided under the law of that country for consumer contracts).

We will first attempt to resolve disputes informally, please contact legal@cardcuepro.com before filing a formal claim. If we cannot resolve a dispute informally within 60 days, either party may pursue available remedies.

16. Export Compliance

Cue uses only standard HTTPS and iOS-provided cryptography. The App qualifies as exempt under U.S. Export Administration Regulation §740.17(b)(1) and is not exported to, or used by, anyone located in a country subject to U.S. embargo or listed on a prohibited-parties list.

17. Apple End User License Agreement (App Store)

The App is licensed to you, not sold. Your license is governed by these Terms and, to the extent Apple requires, by Apple's Standard End User License Agreement. In particular you acknowledge and agree that:

18. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, in whole or in part, under the law of any jurisdiction, that provision will be reformed to the minimum extent necessary to make it enforceable, or (if it cannot be reformed) severed. The remaining provisions of these Terms will continue in full force and effect in that and every other jurisdiction. A provision held unenforceable against a consumer in one jurisdiction remains enforceable against non-consumer users and users in other jurisdictions.

19. Entire Agreement

These Terms, together with our Privacy Policy and any subscription or in-app purchase terms you accept at the point of purchase, constitute the entire agreement between you and CardCue Pro with respect to the App, and supersede all prior or contemporaneous communications, proposals, and agreements (whether oral or written) relating to the subject matter. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

20. Assignment

You may not assign, transfer, or sublicense these Terms or any of your rights or obligations under them without our prior written consent; any purported assignment in violation of this Section is void. We may assign these Terms (in whole or in part) to an affiliate, to a successor in interest (including by way of merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets), or to any party that agrees to be bound by these Terms, without your consent and without notice, provided such assignment does not materially diminish your rights as a consumer.

21. Notices

We may give you notice by posting in the App, by sending email to the address associated with your account, or by any other reasonable means. Notices to us must be in writing and sent to legal@cardcuepro.com. Notices are deemed received 24 hours after email is sent (unless we receive a bounce notice) or when delivered in the App. Consumers retain the right to use any formal notice method required or permitted by applicable law in their jurisdiction.

22. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, fire, flood, earthquake, storm, pandemic, epidemic, war, terrorism, civil unrest, strikes or labor disputes (other than involving our own workforce), government action, changes in applicable law, failures of the public internet, telecommunications, or cloud-infrastructure providers (including Apple, Supabase, or their sublicensees), cyberattacks, and outages affecting third-party APIs on which the App depends. This Section does not excuse payment obligations and does not limit any rights a consumer has under mandatory law.
